Terms of Service
1. Agreement to Terms
By accessing or using TJP ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.
2. Description of Service
TJP provides AI-powered image and video generation services ("Generation Services"). Users can submit text prompts to generate visual content using our platform.
3. Account Registration
3.1 Eligibility
You must be at least 18 years old to use this Service. By creating an account, you represent and warrant that:
- You are at least 18 years of age
- You have the legal capacity to enter into this agreement
- You are not prohibited from using the Service under applicable laws
We reserve the right to request proof of age at any time and may use third-party age verification services. Providing false age information is grounds for immediate account termination.
3.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
3.3 Account Information
You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.
3.4 Biometric Data Notice
For users in Illinois, Texas, Washington, and other jurisdictions with biometric privacy laws:
If you upload images containing faces or other biometric identifiers:
- We may process facial geometry data solely for the purpose of generating requested content
- This data is used transiently and is not stored in a biometric database
- We do not sell, lease, or trade biometric data
- Biometric data is deleted promptly after generation completion or failure, subject to legal requirements and backup retention policies
- By uploading images containing faces, you consent to this processing and represent that you have obtained consent from any individuals depicted
If you do not consent to this processing, do not upload images containing biometric identifiers.
4. Credits and Payments
4.1 Credit System
- The Service operates on a credit-based system
- Credits are required to generate content
- Credit costs vary based on generation type and quality settings
4.2 Purchases
- All purchases are final unless otherwise stated
- Prices are subject to change with notice
- You agree to pay all charges at the prices in effect when incurred
4.3 Subscriptions
- Subscription plans auto-renew unless canceled
- Cancel at least 24 hours before renewal to avoid charges
- Unused credits may expire according to plan terms
4.4 Refunds
- Credits are refunded automatically for failed generations caused by platform errors
- No refunds are issued for subscriptions or credit purchases
- Subscriptions can be canceled at any time; access continues until the end of the current billing period
- For billing errors, contact us for correction on the next billing cycle
4.5 Creator Earnings and Paid Unlocks
Community features let creators earn platform credits when other members recreate their published posts or purchase access to a post's recipe:
- Creator earnings accrue as platform credits. When published content is itself a recreation, our reward formula fairly shares earnings between the original creator and the re-creator.
- Earnings are subject to a review hold before they can be claimed, and may be reversed in cases of fraud, abuse, or Terms violations — including after claim.
- Paid unlocks are a one-time charge granting your account permanent access to recreate that post. The charge buys recipe access, not generation: generation runs are charged separately and are not refunded through the unlock.
- If a post you paid to unlock is removed or taken down, your unlock payment is refunded in credits.
- Reward values, formulas, and eligibility requirements are set by the platform and may change prospectively at any time.
5. DMCA and Copyright Policy
5.1 Respect for Intellectual Property
We respect the intellectual property rights of others and expect users to do the same. We will respond to notices of alleged copyright infringement that comply with applicable law.
5.2 Filing a DMCA Notice
If you believe content on our Service infringes your copyright, send a notice to our Designated Agent with:
- Your physical or electronic signature
- Identification of the copyrighted work claimed to be infringed
- Identification of the allegedly infringing material and its location on our Service
- Your contact information (address, phone number, email)
- A statement that you have a good faith belief that the use is not authorized
- A statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner

5.3 Counter-Notification
If you believe your content was removed in error, you may submit a counter-notification containing:
- Your physical or electronic signature
- Identification of the removed material and its prior location
- A statement under penalty of perjury that you have a good faith belief the material was removed by mistake
- Your name, address, and phone number
- Consent to jurisdiction of federal court
- Agreement to accept service of process from the complainant
5.4 Repeat Infringers
We will terminate accounts of users who are repeat infringers in appropriate circumstances.
6. Acceptable Use
6.1 You Agree NOT to:
1. Generate illegal content, including but not limited to:
- Child sexual abuse material (CSAM)
- Non-consensual intimate imagery
- Content that violates any applicable law
2. Generate harmful content, including:
- Graphic violence or gore
- Content promoting terrorism or violence
- Harassment or bullying of individuals
3. Create deceptive content, including:
- Deepfakes of real people without consent
- Misinformation intended to deceive
- Fraudulent or scam-related material
4. Abuse the platform, including:
- Attempting to bypass content filters
- Reverse engineering or scraping the Service
- Interfering with platform security or integrity
- Using automated systems without authorization
5. Violate intellectual property, including:
- Infringing copyrights, trademarks, or patents
- Generating content that infringes third-party rights
6.2 Content Moderation
- We automatically screen prompts before generation
- We reserve the right to refuse any generation request
- Repeated violations may result in account termination
- We may report illegal content to law enforcement
7. Intellectual Property
7.1 Your Content
- You retain rights to prompts you create
- You grant us a license to process your prompts for service delivery
- You are responsible for ensuring you have rights to any input content
7.2 Generated Content
- Subject to these Terms, you own the generated outputs you create
- You may use generated content for personal or commercial purposes
- This license is contingent on compliance with these Terms
7.3 Platform Intellectual Property
- The Service, including its design, features, and technology, is owned by us
- You may not copy, modify, or create derivative works of the Service
- Our trademarks and branding may not be used without permission
7.4 Limitations
Your rights to generated content are LIMITED if:
- The content violates these Terms
- The content infringes third-party rights
- Your account is terminated for violations
7.5 No Resale or Redistribution of Service
You may not:
- Resell, sublicense, or redistribute access to the Service
- Offer the Service's capabilities to third parties as a competing service
- Use the Service to build a substantially similar product or service
- Share account credentials with unauthorized parties
- Act as a service bureau or provide the Service on behalf of third parties without written authorization
This does not restrict your right to use generated content commercially as permitted under Section 7.2.
7.6 Promotional Use
We may use anonymized, aggregated data about Service usage for promotional and marketing purposes. We will NOT use your specific generated content for promotional purposes without your express consent, except:
- Content you voluntarily share publicly through our community features
- Content you explicitly submit to promotional programs or contests
7.7 Community Publishing and Recipe Sharing
Publishing a creation to the community makes it visible to the audience you select and makes your creator profile public. If you enable recreation:
- You grant recreating members a license to use the post's prompt, settings, and non-identity reference media to generate their own content. Your avatar is never shared — recreations resolve against the recreating member's own avatar.
- Recreations may themselves be published to the community and earn; our reward formula fairly shares their earnings between you and the re-creator (see Section 4.5).
- You represent that you hold the necessary rights to any reference media in the post and that it does not depict real people without their permission.
- We may remove posts, disable recreation, or restrict community access at any time under our moderation policies. Disabling recreation on your own post does not revoke access for members who already unlocked it.
8. Third-Party Services and AI Providers
8.1 Third-Party AI Infrastructure
The Service may utilize third-party AI model providers and cloud infrastructure to deliver generation capabilities. By using the Service, you acknowledge that:
- Your prompts and inputs may be processed by third-party systems
- We select providers who meet our security and privacy standards
- Third-party providers are contractually bound to protect your data
- We are not responsible for third-party provider outages or service interruptions
8.2 Third-Party Integrations
If the Service integrates with third-party services (payment processors, authentication providers, etc.):
- Your use of such services is subject to their respective terms
- We do not control and are not responsible for third-party services
- We may receive data from these services as described in our Privacy Policy
9. Privacy and International Data Processing
9.1 Privacy Policy
Your use of the Service is subject to our Privacy Policy. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.
9.2 International Users
If you are located outside the United States, please note:
- Your data will be transferred to and processed in the United States
- By using the Service, you consent to this transfer
- We rely on Standard Contractual Clauses and other lawful transfer mechanisms for data transfers
9.3 European Economic Area (EEA) Users
If you are located in the EEA, UK, or Switzerland:
- We act as the data controller for personal data collected through the Service
- Our legal basis for processing includes: contract performance, legitimate interests, and your consent
- You have rights under GDPR including access, rectification, erasure, portability, and objection
- You may lodge a complaint with your local supervisory authority

10. Disclaimers
10.1 "As Is" Service
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY OF RESULTS
10.2 AI Limitations
- Generated content may contain errors or inaccuracies
- We do not guarantee specific results
- Generated content may not be suitable for all purposes
10.3 Service Availability
- We do not guarantee uninterrupted service
- We may modify or discontinue features without notice
- Scheduled maintenance may cause temporary unavailability
11. Limitation of Liability
11.1 Exclusion of Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, or consequential damages
- Loss of profits, revenue, data, or business opportunities
- Damages arising from your use of generated content
- Damages exceeding the amount you paid in the past 12 months
11.2 Essential Purpose
These limitations apply even if we have been advised of the possibility of such damages and even if any remedy fails of its essential purpose.
12. Indemnification
You agree to indemnify, defend, and hold harmless TJP and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Content you generate using the Service
13. Termination
13.1 By You
You may terminate your account at any time by:
- Using the account deletion feature in settings
- Contacting us via our contact page
13.2 By Us
We may suspend or terminate your account immediately if:
- You violate these Terms
- You engage in illegal activity
- Required by law or regulation
- We discontinue the Service
13.3 Effect of Termination
Upon termination:
- Your right to use the Service ends immediately
- Unused credits may be forfeited
- We may delete your data according to our Privacy Policy
- Provisions that should survive (e.g., limitations of liability) will survive
13.4 Data Retention and Deletion
During Active Use:
- Generated content is stored for 30 days unless you delete it sooner
- Prompts and generation metadata are retained for service improvement and abuse prevention
- You may download your generated content at any time while your account is active
Upon Account Deletion:
- Generated content is permanently deleted within 30 days of account termination
- Account data (email, profile) is deleted within 30 days, except as required for legal compliance
- Anonymized usage data may be retained indefinitely for analytics
- Backups containing your data are purged within 90 days
Legal Holds:
We may retain data longer if required by law, legal proceedings, or to enforce our Terms.
Data Export:
You may request an export of your data by contacting us. We will provide your data in a commonly used format within 30 days.
14. Dispute Resolution
14.1 Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
14.2 Arbitration
Any disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual property violations.
14.3 Class Action Waiver
You agree to resolve disputes individually and waive any right to participate in class actions.
14.4 Time Limit
Any claim must be filed within one (1) year of the event giving rise to the claim.
14.5 Exceptions for EU/EEA/UK Users
If you are located in the European Union, European Economic Area, United Kingdom, or Switzerland:
- The arbitration and class action waiver provisions (Sections 14.2 and 14.3) do not apply to you
- You may bring claims in your local courts as permitted by applicable law
- Nothing in these Terms limits your statutory consumer rights
- The governing law clause does not deprive you of mandatory consumer protections in your country of residence
15. Export Compliance
15.1 Export Restrictions
The Service is subject to United States export control laws and regulations. You agree that:
- You will not use, export, or re-export the Service in violation of applicable export laws
- You are not located in, or a resident of, any country subject to U.S. sanctions (including Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions)
- You are not on any U.S. government restricted parties list
15.2 Compliance Responsibility
You are responsible for compliance with all applicable export laws and regulations in your jurisdiction.
16. Changes to Terms
16.1 Modifications
We may modify these Terms at any time. We will provide notice of material changes by:
- Email to your registered address
- Prominent notice on the Service
16.2 Continued Use
Your continued use of the Service after changes constitutes acceptance of the modified Terms.
17. General Provisions
17.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and TJP regarding the Service.
17.2 Severability
If any provision is found unenforceable, the remaining provisions will continue in effect.
17.3 Waiver
Our failure to enforce any provision does not waive our right to enforce it later.
17.4 Assignment
You may not assign your rights under these Terms. We may assign our rights without restriction.
17.5 Force Majeure
We are not liable for failures due to circumstances beyond our reasonable control.
